Terms of Service

Welcome to Get2Getha! By accessing or using our mobile application ("App") or website ("Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use our services.

1. Who We Are

Get2Getha is a social coordination platform that helps users create, join, and manage in-person events and gatherings. We provide tools for communication, discovery, and location sharing to facilitate meetups.

2. Eligibility

  • You must be at least 16 years old to use the App. If you are under 18, you must have parental or guardian consent
  • By using the App, you represent and warrant that you meet these requirements

3. Account & User Responsibilities

  • You must provide accurate, complete, and up-to-date information when creating an account
  • You are responsible for maintaining the confidentiality of your login credentials
  • You may not use another person's account without authorization

Account Names, Usernames, and Business Profiles

  • Display names are not unique and may be used by more than one account. A display name does not grant ownership of that name, brand, business identity, trademark, or any related rights
  • Usernames and handles are unique within Get2Getha and are generally made available on a first-come, first-served basis. Creating or using a username does not give you ownership of that username, nor does it give you any legal rights to a business name, brand name, trademark, or identity
  • Businesses, organizations, venues, and other entities may be allowed to create business profiles or apply for business verification
  • A verified business may use the same or a similar display name as another account, but verified status may be shown to help users distinguish business profiles from regular user accounts
  • If a desired username is already in use, the business or organization may be required to choose a different username
  • We may reserve, restrict, rename, suspend, remove, or reclaim usernames, display names, business profiles, or account identifiers at our discretion, including when we believe they may impersonate another person or business, mislead users, infringe intellectual property rights, be used for username squatting or resale, conflict with Get2Getha's own platform operations, or violate these Terms
  • If you believe an account is impersonating you, your business, or your organization, or if you believe a username or profile violates your rights, you may report the account to Get2Getha for review. We may request documentation or other information to evaluate the report, but we are not obligated to assign, transfer, or reserve any username except where required by law

Business Verification

  • Business verification means that Get2Getha has taken steps to confirm that the account appears to represent the business, organization, venue, or entity associated with the profile
  • Verification may include review of business information, public records, website or domain control, business email or phone confirmation, documentation, or other evidence that we consider appropriate
  • Verification does not mean that Get2Getha endorses, sponsors, guarantees, recommends, certifies, or is responsible for the business, its events, its services, its safety, its quality, or the accuracy of information provided by the business
  • We may approve, deny, suspend, remove, or revoke verification at any time if we believe the profile information is inaccurate, incomplete, misleading, outdated, unauthorized, abusive, or otherwise violates these Terms

Prohibited Conduct

You agree that you will not, directly or indirectly:

  • Use the App for unlawful, harmful, or misleading purposes
  • Engage in or promote harassment, hate speech, discrimination, or violence
  • Upload or distribute content that infringes intellectual property, privacy, or other rights
  • Attempt to reverse engineer, decompile, disassemble, or otherwise derive source code from the App
  • Interfere with or disrupt the operation of the App (including bypassing security measures, using bots, or scraping data)
  • Use the App in connection with fraud, scams, or other illegal activity
  • Submit flyers, recordings, or images for optional AI processing that you do not have the right to use, or that contain another person's personal information without a lawful basis

4. Location Data & Permissions

  • The App may collect and use your device's location in the background for features such as check-ins, event discovery, and safety
  • By enabling location services, you consent to this usage in accordance with our Privacy Policy

5. User Content

  • You may post content (e.g., messages, images, flyers, and voice recordings) while using the App
  • You retain ownership of your content, but you grant us a worldwide, non-exclusive, royalty-free license to use, store, reproduce, display, and distribute it as necessary to operate and improve the App
  • You agree not to post anything unlawful, abusive, defamatory, obscene, or otherwise objectionable
  • We reserve the right (but are not obligated) to remove or restrict content that violates these Terms

6. Optional AI Features

  • The App may offer optional features that use automated processing, including Scan Flyer, Create with Voice, and header image generation. These features are not required to create a G2G
  • By using an optional AI feature, you instruct us to send the content you submit for that request (such as a flyer or image, a short voice recording, event details, and any reference image) to our service providers, including Google (Gemini / Google AI), as described in the Privacy Policy
  • You represent that you have the right to submit that content
  • AI output is a suggestion only. It may be inaccurate, incomplete, or inappropriate. You must review and edit suggested event fields and generated images before you create, update, or share a G2G. You are responsible for the G2G you publish
  • If you save a generated header on a G2G, it is treated as your User Content under these Terms. We do not warrant that generated images are unique, accurate, or free of third-party rights
  • We may limit, suspend, or disable optional AI features, including by daily quotas or remote configuration, at any time
  • Processing of source media for these requests is described in the Privacy Policy

7. Public and Nearby Events

  • Events marked as "Public" or "Nearby" may be visible to other users based on distance or Bluetooth proximity
  • You understand and accept the risks associated with joining or hosting real-world events

8. Safety & Disclaimers

  • We are not responsible for the behavior, actions, or safety of users at events
  • You are solely responsible for your safety and conduct during meetups
  • Use common sense and caution when interacting with others or attending events

9. Termination

We may suspend or terminate your account, with or without notice, if you:

  • Violate these Terms
  • Engage in unlawful, harmful, or disruptive behavior
  • Misuse the App in a manner that threatens the safety, integrity, or rights of others

10. Intellectual Property

  • All rights, title, and interest in and to the App (including software, trademarks, and content created by us) remain the property of Get2Getha LLC and its licensors
  • Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works from any part of the App

11. Limitation of Liability

To the fullest extent permitted by law:

  • Get2Getha shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the App or participation in events
  • We do not guarantee the availability, safety, or accuracy of any event, user, or optional AI output

12. Governing Law

  • These Terms are governed by the laws of North Carolina and the United States of America, without regard to conflict of law principles

13. Dispute Resolution & Arbitration

  • Informal Resolution: Before filing a claim, you agree to first contact us at support@get2getha.com to attempt to resolve the dispute informally
  • Binding Arbitration: If a dispute cannot be resolved informally, you agree that it will be settled through binding arbitration, conducted by a recognized arbitration body under its applicable rules
  • Class Action Waiver: You agree that disputes will be resolved only on an individual basis, and not in a class, collective, or representative action
  • Exceptions: Either party may bring a claim in small claims court, or seek injunctive or equitable relief for intellectual property infringement or misuse without arbitration
  • Governing Law: Any arbitration will take place in North Carolina, and North Carolina law will apply

15. Data Collection and Usage

By using Get2Getha, you acknowledge and agree that we may collect and process certain types of data, including:

  • Personal Information (phone number, username, email, Firebase UID)
  • Location Data (background and foreground)
  • Bluetooth Signals (for proximity-based features)
  • Event Participation and Interaction Logs
  • Device Data (app version, crash logs, platform, device model, OS version)
  • Optional AI inputs (flyer/images, voice recordings, and event context or reference images used for header generation), processed as described in the Privacy Policy
